A Thought On Trump v The BBC

Nearly twenty years ago, I shared a train journey between Cambridge and London, with a delightful black lady, who was probably in her seventies. It turned out she was a New York State Supreme Court Judge, who was doing a bit of week-end sight-seeing, whilst at a legal conference at Cambridge University.

One of the big regrets in my life, is that I didn’t exchange cards with this wonderful lady, as it would be so revealing to ask her opinion of Trump v. The BBC.

But, I also feel it is too late, as my research indicates, that she might be now giving judgments in a higher court.

But if that lady is typical of the quality of US Supreme Court justices, at both Federal and State level, then I am fairly sure, that anybody who appeals to their court will get a fair hearing according to the law.

Could that be a difficulty for someone with Trump’s personality?

  1. The judiciary by and large appears to be independent, the problems lay more with juries and the states the cases are held in.

    I would fear for anything that reached the Supreme Court

    • It should also be said, that in her forty years of practice, my late wife had a couple of family law custody cases, that ended up in American courts.

      In all cases the American courts followed the International law (Hague Convention (?)), which can’t always be said for some EU countries.

      I seem to remember one case, where the Suffolk social worker in the case, went out to collect the child from Alabama and there was not even the slightest problem.

  2. Nearly 20 years ago this woman was in her 70ies. In case she is still alive she is in her 90ies now.

    And your research indicates that she might be working somewhere else now. Seriously ?

    • It was only a friendly jooke, which is often said about judges.
